Caregiver Agreements & Disclosures

Every caregiver accepts each of the following before a profile can be submitted for review. Background check authorization is presented and accepted as a standalone disclosure and authorization, separate from the general platform agreement.

1. 1. Caregiver Platform User Agreement

   I agree to the rules for creating and maintaining a directory profile and for using this website.

   This agreement governs your use of the Avida Personal Care Caregiver Directory (the "Directory"). By creating a profile you agree to these terms.Eligibility. You must be at least 18 years old, legally authorized to work in the United States, and able to provide accurate information about your caregiving background.Your profile. You are responsible for the content you submit. You agree to keep your profile current, to describe your experience and qualifications truthfully, and to pause or remove your profile when you are not available for work.Acceptable use. You agree to use the Directory only to present your caregiving services and to respond to inquiries received through the site. You will treat everyone you encounter through the Directory with respect and professionalism.Prohibited conduct. You may not: publish direct contact information of any kind; solicit families to move communication off the platform before Avida has facilitated a connection; misrepresent your identity, credentials, or work history; upload content you do not have the right to use; harass, discriminate against, or endanger any person; post content that is unlawful, obscene, or misleading; use automated tools to scrape or copy the Directory; or create more than one active profile.Review and moderation. Every profile and every profile change is reviewed by an Avida administrator before it appears publicly. Avida may edit for clarity, decline to publish, request corrections, or remove content at its discretion.Suspension and removal. Avida may pause, suspend, or permanently remove a profile and revoke account access at any time, with or without prior notice, including for violations of these agreements, unresolved complaints, failure to keep information accurate, or conduct that Avida reasonably believes puts a client at risk.Reported accounts. Families and Avida staff may report a profile. Reports are reviewed by an administrator, who may contact you for a response before deciding.Communication with prospective clients. Until Avida facilitates a connection, all communication must take place through the Directory's inquiry and response tools. You may not attempt to obtain or share private contact details through those tools.Disputes. If a disagreement arises between you and Avida about your account or profile, you agree to first raise it in writing with Avida and to work in good faith toward a resolution for at least thirty (30) days before pursuing any other remedy. This agreement is governed by the laws of the State of Wisconsin.Changes. Avida may update this agreement. Material changes will be presented to you for acceptance the next time you sign in; continued use of the Directory after acceptance is required to keep your profile published.

2. 2. No Direct Contact Information Agreement

   I agree never to publish or attempt to share direct contact information anywhere on my profile or in public content.

   The Directory is a closed platform. All first contact between a caregiver and a prospective client is handled by Avida.I agree that I will not publish, embed, hint at, encode, or otherwise attempt to share any of the following through my profile, my biography, my display name, my photograph, my uploaded files, my responses to inquiries, or any other public content: telephone numbers; email addresses; home, mailing, or street addresses; social media accounts or handles; website or blog links; messaging or payment app usernames; QR codes or scannable images; or any other method by which someone could contact me directly.I understand this restriction applies to indirect and disguised forms as well, including numbers spelled out in words, letters substituted for symbols, contact details written inside an uploaded image or document, and instructions telling someone how to find me elsewhere.I understand Avida uses automated screening in addition to human review, and that flagged content will not be published until it is corrected and re-reviewed.I understand that if I violate this agreement Avida may remove the content, reject the profile change, pause or suspend my profile, or terminate my access to the Directory, at Avida's sole discretion and without refund of any fee.

3. 3. Profile Publication and Information-Sharing Consent

   I authorize Avida to publish the approved information in my profile and understand what stays confidential.

   I authorize Avida Personal Care to display, on the public Caregiver Directory, the information in my profile that Avida has reviewed and approved.Information that may appear publicly: my approved display name (first name and last initial, or another approved display name); my approved profile photograph; my city, county, or general service area; my professional biography; my years of caregiving experience; languages I speak; certifications and training; the types of care and services I provide; my availability and preferred schedule; whether I have transportation; my preferred work locations; a summary of references or reviews; and my verification or background-check status as determined by Avida.Information that remains confidential and is visible only to authorized Avida administrators: my legal name; my telephone number, email address, and home address; my expected pay or hourly rate; identification documents; background-check records and results; uploaded credentials and supporting documents; reference contact details; and any notes Avida records about my account.I understand that Avida decides what is published and may decline to publish any item.I understand that publication is not an endorsement, guarantee, or recommendation of me by Avida.

4. 4. Information Accuracy and Credential Certification

   I certify that everything I submit is accurate, current, and not misleading, and I will keep it updated.

   I certify that all information I submit to the Directory — including my biography, work history, years of experience, certifications, training, licenses, references, and any uploaded documents — is true, accurate, current, and not misleading.I certify that any certification, license, or credential I list is validly issued to me, is not expired, suspended, or revoked, and that I will remove it from my profile immediately if that changes.I agree to update my profile promptly whenever my availability, qualifications, service area, or any other listed information changes, and at minimum whenever Avida requests a periodic confirmation.I understand that submitting false, incomplete, or misleading information is grounds for immediate removal from the Directory and may be reported to the appropriate licensing or regulatory authority.

5. 5. Photo, Name, and Content Release

   I authorize Avida to display my approved name, photo, biography, and profile content in the directory.

   I grant Avida Personal Care a non-exclusive, royalty-free license to display, reproduce, and format my approved display name, photograph, biography, and profile content for the purpose of operating and promoting the Caregiver Directory and connecting me with prospective clients.I confirm that I own or have permission to use any photograph or content I upload, and that it does not include any other identifiable person without their permission.I understand Avida may resize, crop, or lightly edit my photograph for presentation, and may decline any photograph that contains contact information, other people, or content inconsistent with a professional directory.If I pause my profile, my content is hidden from the public Directory but retained in my account so I can republish it.If I close my account or Avida removes my profile, my content is removed from public view promptly and in no event more than seven (7) days later. Avida may retain an internal copy as described in the Privacy Policy and Data Consent agreement, including where retention is required for legal, regulatory, safety, or dispute-resolution purposes.I understand that copies already distributed or cached by third parties, including search engines, are outside Avida's control, though Avida will make reasonable efforts to request removal on my request.

6. 6. Privacy Policy and Data Consent

   I acknowledge how my personal information is collected, used, stored, shared, retained, and deleted.

   I acknowledge that I have read Avida's Privacy Policy and consent to the collection and use of my information as described there and here.What is collected: account details (email address and sign-in identifiers); profile content; private contact and pay information; uploaded credentials and identification documents; background-check and verification records; reference information; records of inquiries and my responses; and technical data such as IP address and browser type.How it is used: to operate and moderate the Directory; to verify identity, credentials, and eligibility; to review and approve profiles; to route and facilitate connection requests; to communicate with me about my account; to comply with legal, regulatory, and program requirements; and to protect the safety of clients, caregivers, and staff.How it is stored and reviewed: information is stored on access-controlled systems. Private information is available only to authorized Avida administrators, who review profiles and documents as part of the approval process.How it is shared: Avida does not sell personal information. Information is shared only with service providers who help operate the Directory (such as hosting, email, storage, and background-check vendors) under confidentiality obligations, and where required by law or to protect someone's safety.What never appears publicly: identification documents; background-check records; my telephone number, email address, and complete home address; my legal name where a display name is used; my expected pay rate; and reference contact details.Retention: profile content is retained while the account is active. After account closure, Avida retains records only as long as needed for legitimate business, legal, and dispute-resolution purposes, generally not more than seven (7) years, then deletes or anonymizes them.My rights: I may request access to, correction of, or deletion of my personal information at any time through my dashboard or by contacting Avida. Avida will respond within a reasonable period and will explain any information it must retain by law.

7. 7. Background Check Disclosure and AuthorizationStandalone

   Separate authorization: I consent to Avida obtaining background-check reports about me.

   DISCLOSURE — PLEASE READ CAREFULLY. This is a separate, standalone disclosure. It is not part of any other agreement.Avida Personal Care may obtain one or more consumer reports or investigative consumer reports about you for purposes related to your participation in the Caregiver Directory. These reports may include information about your criminal history, sex-offender registry status, caregiver misconduct registry status, identity verification, driving record, and, where relevant, employment and education history.These reports may be prepared by a consumer reporting agency on Avida's behalf. You have the right to request, in writing and within a reasonable time, a complete and accurate disclosure of the nature and scope of any investigative consumer report, and a written summary of your rights under the federal Fair Credit Reporting Act.If information in a report may lead Avida to decline, pause, or remove your profile, you will be given a copy of the report, a summary of your rights, and a reasonable opportunity to dispute or explain the information before a final decision is made.AUTHORIZATION. By accepting below, I authorize Avida Personal Care and any consumer reporting agency it uses to obtain the reports described in this disclosure, now and, unless I withdraw this authorization in writing, on a periodic basis for as long as my profile is active. I understand this authorization is separate from the Caregiver Platform User Agreement and that I may decline it, in which case my profile will not be published.I understand background-check results are confidential, are not published on my profile, and that only a general verification status (such as "verified") may be displayed.

8. 8. Reference and Credential Verification Authorization

   I authorize Avida to contact my references and verify my employment, training, licenses, and credentials.

   I authorize Avida Personal Care to contact the references I provide and to verify the information I submit, including my employment and caregiving work history, training, certifications, licenses, registry status, driving information where relevant, and any other qualification I list.I authorize my former and current employers, schools, training programs, certifying bodies, and licensing agencies to release the information Avida requests for this purpose, and I release them and Avida from any claim arising from the good-faith release or verification of that information.I understand that verification may continue periodically while my profile is active, and that Avida may pause or remove my profile if a credential cannot be verified or is found to be inaccurate.I understand that reference contact details I provide are confidential, are used only for verification, and are never published.

9. 9. Independent Directory and Employment Disclaimer

   I understand this is a directory listing and does not by itself create an employment relationship with Avida.

   The Caregiver Directory is an informational listing service. Avida Personal Care operates the Directory to help Wisconsin families find and connect with caregivers.Listing a profile in the Directory does not, by itself, create an employment relationship, agency relationship, partnership, or joint venture between you and Avida. Being listed is not an offer of employment and does not guarantee any placement, referral, hours, or income.If you are separately hired by Avida as an employee under Wisconsin's Medicaid personal care programs, that relationship is governed by your separate employment paperwork, not by this agreement. Where the two conflict for employment purposes, your employment paperwork controls.Where a family engages you outside of an Avida employment arrangement, you are responsible for your own tax obligations, insurance, licensing, and compliance with applicable law, and Avida is not a party to that arrangement.Avida does not supervise, direct, or control the caregiving services you provide outside of an Avida employment arrangement, does not set your rates in that context, and does not guarantee the conduct, suitability, or safety of any family or caregiver introduced through the Directory.Avida screens profiles and may verify credentials, but a listing is not a warranty, endorsement, or guarantee of any caregiver's qualifications, character, or performance. Families are encouraged to conduct their own interviews and due diligence.Nothing in this agreement limits any right you have under applicable federal or Wisconsin law.
